2009 - 2010 Economic Reopener Agreement
A. 2009 – 2010 Economic Reopener Provisions
Period Covered by the Agreement. This agreement covers the academic year beginning July 1, 2009 and ending June 30, 2010.
1. Salary. The College and the Association have agreed to the following with regard to salary and reflected in the attached salary schedules.
1.1 Salary Steps
2.1.1. There will be half-step advancement for all eligible contracted and part-time faculty employed during the 2009 – 2010 fiscal year.
2.1.2. There will be full-step advancement for all eligible part-time flight tech faculty employed during the 2009 – 2010 fiscal year.
2.1.3. A half-step will be added to the top of the current 13 step contracted salary schedule creating step 13.5.
1.2 Salary Schedule Increases
2.2.1 2009 – 2010 Compensation Adjustment. The 2008 – 2009 salary schedules shall be increased by 2.3% effective July 1, 2009. See the 2009 – 2010 Salary Schedules in the Appendix.
2.3 Work Year and Furlough Days. Up to three furlough days may be used to temporarily reduce salaries and the 2008 – 2009 work year of 172 days and the regular 175 day work year for the 2009 – 2010 year only, as follows:
2.3.1 Work Year: The regular contractual work year remains 175 days.
2.3.2 Furlough Day Salary Impact: Each furlough day shall result in a temporary reduction of the salary schedules of 1/172 or .581% of contracted, part-time, and part-time flight instructor 2008 – 2009 salary schedules.
2.3.3 Reserve Fund: An amount equal to the FY09 Ending Fund Balance between 4% and 5% shall be placed in a Reserve to be used if the Community College Support Fund (CCSF) is reduced during FY10 year below the initial appropriation. All such reserve funds remaining on March 31, 2010 shall be used to reduce the tuition surcharge and the furlough days for all employee workgroups using them, proportional to the workgroup share of the FY10 budget. The faculty 2008 – 2009 share is 85%. The administration will make a recommendation to the Board of Education that the reserve fund will be used to reduce the student tuition surcharge by up to one dollar per credit. A minimum of two furlough days will be reduced for faculty if the reserve fund is not used; if it is used, then days will be reduced proportional to the amount left (e.g. 25% used is = 25% reduction of the two day minimum, resulting in a 1.5 day furlough reduction).
March 31, 2010 Note: Recognizing that the Community College Support Fund was not reduced by the State, the Reserve will be used to reduce the additional three furlough days by 2.4 days, and faculty salary schedules will be adjusted upward by 1.40%, retroactive to July 1, 2009. Adjusted salary payments for contracted faculty for the year will be made in one payment for the year by May 25th, 2010. Retroactive payments for part-time faculty will be made by May 25th, 2010; prospective salary payments for part-time faculty for the Spring 2010 term will reflect the adjusted part-time salary schedule.
2.3.4 2009 – 2010 Calendar: the 2009 – 2010 calendar will be revised as follows:
2.3.4.1 Fall In-service: shall be reduced an additional two days beyond the Fall 2008 two day reduction, leaving three days, Wednesday, September 24 to Friday September 25th. Wednesday morning may be scheduled by the College for the President to meet with the faculty. Wednesday afternoon may be scheduled by the Association for an All Faculty Meeting. Thursday morning may be scheduled by departments/divisions for faculty meetings; Thursday afternoon may be scheduled jointly for interdisciplinary work (e.g. cooperative education, learning communities); faculty members not attending interdisciplinary meetings may use the time for class preparation. Friday shall be a class prep day. No other required activities may be scheduled for faculty members on Thursday afternoon or Friday; however faculty members may be invited to non-required instructional meetings, and such meetings may be scheduled for no more than half a day.
2.3.4.2 Spring In-service 2010: will be a furlough day if necessary and will be moved to April 30, 2010 and recognized as May Day. [Note: see 2.3.4.3, immediately below]
2.3.4.3 March 31, 2010 Note: Recognizing that the CCSF was not reduced by the State and that additional furlough days will be reduced by 2.4 days, Wednesday September 23rd, 2009 is recognized as a class prep day, May 7th 2010 will be a work day and scheduled for Spring in-service, April 30, 2010 remains a work day, and June 12th, 2010 will be scheduled as a partial (0.4) work day and scheduled for graduation attendance, grading, or compensatory time for class preparation or other work activities as determined by faculty members.
4. Post-Retirement
4.1 Contracted Faculty Retirement Rights: Contracted faculty members retiring from the College and from PERS shall have a right to work from 0.50 FTE up to .70 FTE annual assignment for up to two (2) years after retirement as contracted faculty members. This pilot expires on June 30, 2011. Term by term assignment levels may vary from the .50 to .70 range, but may not result in a post-retirement annual assignment greater than .70 FTE.
4.1.1 Salary and Benefits: Contracted faculty members exercising this right shall be paid on the contracted faculty salary schedule on the step they retired from, are eligible for cost of living adjustments and step advancement, will maintain their seniority accumulation and rights, and are eligible for all contracted benefits except article 23.8 Long Term Leave benefits, and shall not receive College contributions to PERS. All rights and benefits under Article 41: Early Retirement, are deferred until the end of the period of extended post-retirement contracted faculty employment.
4.1.2 Retirement Notice: Faculty members exercising this right shall provide notice to their department dean and the Human Resources Department by or before 60 calendar days prior to the first day of the first term of their reduced work assignment. Faculty members unable to provide 60 calendar days notice and unable to receive a reduced schedule for the very next academic term shall have the two-year post-retirement period commence at the beginning of the next term. The Human Resource Department shall notify the Association of the receipt of such notice within ten (10) working days of the 60 calendar day deadline.
5. Layoffs. There shall be no layoffs of faculty during the length of this Reopener Agreement (July 1, 2009 through June 30, 2010).
6. Curriculum Development Rate. The curriculum development rate is $29.15 hour.
7. Professional Development Rate. The Professional Development Rate remains set at 2.35% of the budgeted contract faculty general fund salaries for 2009 – 2010.
8. Contracted Faculty Overloads: 2009 – 2011
8.1 Right to Assignment: When sections are available for assignment, contracted faculty members have a right to teach up to two (2) overload courses per academic year, inclusive of summer term. Before contracted faculty overload rights apply, part-time faculty with seniority rights will first be assigned requested term-by-term annual and summer assignments that they have seniority rights to, as provided in Article 34.5.3.1. Contracted faculty members may exercise their overload rights prior to assignment of part-time faculty without seniority rights. These two additional classes are limited to a total of 10 credits or .23 annual FTE, whichever is greater. Alterations of teaching assignments, once set, shall follow Article 34.5.4 of the Main Agreement.
8.2 Compensation: Contracted faculty members exercising this option and resulting in an assignment above 1.0 FTE, shall have that portion of their assignment paid on the part-time salary schedule, one step above their contracted step placement. Example: If the contracted faculty member is currently on step 10 of the contracted salary schedule, then the placement will be on step 11 of the part-time salary schedule for the overload assignment(s). All overload assignments other than those resulting from faculty members intentionally exercising their rights under this provision, including all current and any involuntary overloads, remain compensated at the regular (Article 26.2.1.3) overload rate of .85.
8.3 Assignment Process: During spring term department managers shall solicit requests for overload assignments during the coming year from all contracted faculty within their division/department. Assuming courses are available for assignment, overload assignments provided under this Article and the Assignment Rights MOU will be offered to contracted faculty members having elected to exercise this right, starting with the most senior contracted faculty member in a discipline and working through the discipline seniority list in rotation. All faculty members requesting such assignments shall be provided one additional course before any are provided a second.
B. Modifications to the 2005 – 2011 Main Agreement
Period Covered by the Agreement. The following agreements revise the 2005 – 2011 Main Agreement. Modifications are highlighted in bold font, below.
ARTICLE 28 - CONTRACTED FACULTY ADDITIONAL STEP ADVANCEMENT
28.1 Eligibility. Following original placement, any faculty employee may become eligible to advance additional steps on the salary schedule by satisfying the criteria for that pay entry level as stated in Article 27 or through the accumulation of career advancement points using academic credits, degrees, and work experience not used in original placement or in previous level advancement. Once documented, step advancements due for additional educational or work experience qualifications under Article 27 shall take effect with the first payroll of the next academic term.
28.1.1 Any faculty member will immediately become eligible to advance additional steps provided for in Article 27 by demonstrating qualifications, not previously met or applied, for the higher entry level in the field applicable to the individual’s employment.
28.1.2 Employees placed on the contracted salary schedule in 2005 or later are only eligible for additional step advancements that would have placed them at step nine at the time of their placement.
28.1.3 In no event will any faculty member who originally placed in Entry Step Category 3 be eligible to apply for additional step advancement; nor will faculty member who originally placed in Entry Category Step 2 and who has received additional step advancement be eligible; nor will faculty member who originally placed in Entry Category Step 1 and who has received additional step advancement twice (i.e., four steps, or two levels) be eligible for any additional advancement.
28.2 Advancement. Any faculty employee with a master's degree or equivalent may become eligible to advance to a higher level on the salary schedule through the accumulation of career advancement points earned for experience, academic credits and degrees not used in original placement or in previous level advancement. Any faculty employee will immediately become eligible to advance the additional steps provided for in Article 27 by meeting the qualifications for the higher entry level in the field applicable to the individual's employment. The College and the Association agree to study the additional step advancement process during the term of this agreement to assess the need and function of this process and the faculty Step Advancement Committee (see Article 28.3) given a single column salary schedule for contracted faculty.
28.5 Additional Step Corrections: Faculty members having earned an additional level advancement during the previous ten years and who would currently be on a higher step if their additional advancement was instead provided now, shall receive an additional step effective July 1, 2009.
ARTICLE 30 - PART-TIME FACULTY PLACEMENT AND ADVANCEMENT
30.6 Contracted faculty members retiring and moving to part-time faculty status shall be placed on the part-time salary schedule and receive full credit for all years experience and shall not be treated as new employees.
30.6.1 Post-Retirement Replacement: All contracted faculty members having previously moved to the part-time faculty and placed on the salary schedule as a new employee will be re-placed, receiving full credit for their credentials and experience, pro-actively only, effective July 1, 2009.
30.6.2 Effective July 1, 2010, all contracted faculty members being re-hired as Re-employed unit members under the Re-employment of Retired Employees MOA, including those previously rehired under the Re-employment of Retired Employees MOA, will be placed on the contracted salary schedule and receive full credit for their credentials and experience and will not be treated as a new employee for purposes of salary placement.
ARTICLE 33 – INSURANCE
Article 33 is modified as follows:
33.1.3 Contracted employee benefits include: health insurance, with major medical; dental insurance, vision insurance; life insurance; long-term disability insurance.
33.3.1.1 Term Life Insurance, Contract Faculty: For all contracted faculty the College shall provide and pay the premiums for term life insurance coverage per employee.
33.3.1.2 Long Term Disability Insurance, Contract Faculty. For all contracted faculty the College shall provide and pay the premiums for the College’s group long term disability insurance plan.
33.3.1.3 Life insurance, accidental death and disability insurance, and long term disability insurance plans shall be moved from the current provider to those provided through the Oregon Educator Benefit Board (OEBB) beginning October 1, 2009. The Faculty Insurance Committee will select the plans to be offered to employees. The total College contribution for these plans for the 2009 – 2010 year shall remain the same as the 2008 – 2009 year: $24.99/year per contracted faculty member, and the difference per month per faculty member shall be added to monthly employee contributions for health insurance premiums.
33.6 College Student and Staff Health Clinic. Contracted and part-time faculty are eligible to access primary health care services through the College Student and Staff Health Clinic. Eligible faculty shall be assessed $2.00 per semi-monthly payroll period. The College agrees to negotiate with the Association should the fee structure or eligibility for accessing the College Health Clinic need to be adjusted (see below).
C. 2010 – 2011 Economic Reopener Agreement Negotiations
1. The following 2009 – 2010 Economic Reopener bargaining subjects shall be moved to the 2010 – 2011 Economic Reopener negotiations:
A. The Association’s Proposal on Association Rights
B. The Association’s Proposal on Personal Safety
C. The Association’s Proposal on Distance Learning
2. With the exception of the items listed immediately above, the 2010 – 2011 Economic Reopener Agreement negotiations are limited to economic subjects unless mutually agreed by the Association and the College.

MEMORANDUM OF AGREEMENT
BETWEEN
LANE COMMUNITY COLLEGE AND THE LCC EDUCATION ASSOCIATION
Temporary Agreement: 2009 – 2011
TEMPORARY CONTRACTED TEACHING-ONLY FACULTY
The College and Association hereby agree on the following one-time, non-precedent setting, temporary and extraordinary provision. This provision automatically expires June 30, 2010 regardless of the status of negotiations.
This Memorandum of Agreement provides that Temporary Contracted Teaching-Only Faculty positions may be assigned through temporary contracts for up to two years. Such assignments shall be made consistent with the Main Agreement, explicitly including Articles 25.1.1.1 and 34.7. Up to thirteen such positions college-wide may be developed through this MOA.
1. Compensation: Compensation for Temporary Contracted Teaching-Only positions shall be at 85% of contracted rate based on placement on the contracted faculty salary schedule.
2. Selection: Recruitment and selection of faculty for Temporary Contracted Teaching-only assignments shall follow a local (rather than national) process that is consistent with Article 25.1.1.1 of the LCCEA contract.
2.1. A job description based on teaching-only assignments (no “non-teaching” duties) and consistent with College and Division qualifications will be used as part of the selection process.
2.2. Whenever possible, selection will be through a locally posted and competitive process that includes majority faculty representation.
2.3. Part-time faculty who accept a temporary contracted teaching-only assignment shall accrue seniority consistent with Article 34.5.2 of the LCCEA contract during the period of the teaching-only assignment..
This Memorandum shall become effective upon execution by the parties.

This MOU is intended to integrate Main Agreement and 2009 – 2010 Economic Reopener Agreement permanent and temporary agreements governing contracted and part-time faculty assignment rights. It governs assignments for the 2009 – 2010 and 2010 – 2011 academic years.

A. Academic Year Assignments are made in the following order:
1. Contracted faculty (including temporary and teaching-only) are assigned their courses.
2. Part-time faculty with seniority rights are assigned available courses, consistent with Article 34.5.3.1 seniority rights.
3. Contracted faculty members (as defined above) wishing to utilize their right to teach an overload at part-time rates are assigned available courses (limit to two courses per academic year; maximum of 10 credits or .23 annual FTE, whichever is greater; paid at part-time rate + 1 step). Faculty members requesting overload assignments shall be provided one additional course before any are provided a second.
Assignments are made starting with RIF seniority. Each time a section is available, the next most senior contracted faculty on the RIF list is given the opportunity for an assignment until all contracted faculty in the discipline have had an opportunity. Subsequent assignment opportunities start again with the most senior discipline faculty member. (If the overload assignment is the result of any reason other than faculty members intentionally and voluntarily exercising this overload right it will be paid at the regular 85% rate.)
4. Part-time faculty without seniority rights are assigned available courses, up to .6 FTE per term.
5. Part-time faculty with seniority rights wishing to utilize this temporary right to teach an 'overload' (courses above the .5 FTE round up) are assigned additional available courses (limit to two courses per academic year; maximum of 10 credits or .23 annual FTE, whichever is greater, above the part-time roundup provision of Article 34.5.3.2). Part-time faculty members requesting overload assignments shall be provided one additional course before any are provided a second, and in descending order of seniority.
6. Part-time faculty without seniority rights wishing to utilize this temporary right to teach an 'overload' are assigned additional available courses up to two courses total per year (limit to two courses per academic year; maximum of 10 credits or .23 annual FTE, whichever is greater, above the part-time roundup provision of Article 34.5.3.2). Part-time faculty members, without seniority, requesting overload assignments shall be provided one additional course before any are provided a second.
B. Summer Term Assignments are made in the following order:
1. Contracted faculty (including temporary and teaching-only) are assigned their regular course load, if any.
2. Part-time faculty with seniority rights are assigned available courses, consistent with Article 34.5.3.1 seniority rights (see above).
3. Contracted faculty members (as defined above) wishing to utilize their right to teach an overload at part-time rates (limit to two courses per academic year; maximum of 10 credits or .23 annual FTE, whichever is greater; paid at part-time rate + 1 step). Faculty members requesting overload assignments shall be provided one additional course before any are provided a second.
Assignments are made starting with RIF seniority.
